The transport and handling of dangerous goods by road requires a dangerous goods safety advisor. The European Agreement Concerning the International Carriage of Dangerous Goods by Road regulations, companies who handle dangerous goods by road, rail and inland waterway are required by law to appoint a Dangerous Goods Safety Advisor (DGSA). These regulations require the DGSA pass a series of examinations approved in writing by the Secretary of State to enable them to carry out specific statutory functions and duties from the 31st December 1999.

The DGSA has the statutory due to ensure the preparation of accident reports, however the regulations also include a list of specific functions to be carried out by the DGSA.

Functions of the DGSA:

  • Monitoring compliance with the rules governing the transport of dangerous goods.
  • Advising the employer on the transport of dangerous goods
  • Ensuring that an annual report to the employer is prepared on the activities of the employer concerning the transport of dangerous goods
  • Monitoring the practices, procedures and activities of the employer, concerning dangerous goods.

The statutory duties outlined in the regulations are placed on the employer rather than the DGSA. However, the employer must provide the DGSA with relevant facilities to ensure the duties are complied properly.

From the 31st December 1999

  • Personnel employed by road vehicle operator or consignor of dangerous goods.
  • Personnel who load or unload dangerous goods
  • Personnel in freight forwarding or shipping agencies.

Must receive training in the requirements governing the carriage of such goods appropriate to their responsibilities and duties.

General awareness training.
Personnel should be familiar with the general requirements of the provisions of the carriage of dangerous goods by road
Function specific training.
Personnel should receive detailed training, commensurate directly with their duties and responsibilities
Safety Training.
Personnel should receive training commensurate with the degree of risk of injury or exposure arising from an accident involving the carriage of dangerous goods.
 
Details of all training will be kept by both the employer and the employee and will periodically supplemented with refresher training to take account of changes in legislation. Training valid for five years.
